Entries from any digital cameras, including smartphones, will be accepted for all Nikon Photo Contest 2018-2019 categories.

Prizes and rewards are subject to change without notice and cannot be exchanged, transferred, or redeemed for cash. Note that in the event of a conflict with the laws and regulations of a country, such as those pertaining to exports, or in the event of restrictions on the sale or use of a prize within the winner's country of residence, the prize may be undeliverable to the winner. In this case, a different prize will be awarded at the discretion of the organizer.

How to Enter

Enter the contest by providing the required information in the entry form on this website. This form will become available on the first date entries are accepted (Thursday, October 18th, 2018).

Entry Period

Thursday, October 18th, 2018 (opens at 1:00 p.m. Japan standard time) to Thursday, January 31st, 2019 (closes at 1:00 p.m. Japan standard time)

Eligibility

The contest is open to all, professional and amateur, regardless of age, gender, or nationality.

  • Entrants under 18 years of age require the permission of a parent or guardian. By entering the contest, entrants under 18 years of age indicate that they have obtained the permission of a parent or guardian.
  • The contest is not open to employees of Nikon (the "organizer") or its subsidiaries or affiliates.

Submission Rules

    Photo Entries

  • Entry is limited to original works that have not formerly been displayed or exhibited and for which the entrant holds all applicable rights.
  • Works that have won prizes in other contests or that have been submitted to other contests currently underway, including similar works, are not eligible. Even works that are entered in other competitions after submission to this contest will be regarded as having been submitted to other contests currently underway.
  • The limit for submitted works is 10 photos, including those forming photo stories. Entries can be submitted in multiple categories if the total number of entries is within this limit.
  • Works that are identical or similar to another submitted work ("identical or similar works"*1) as well as works including identical or similar works submitted as separate works are ineligible for submission.

Note:
*1 "Identical or similar works" refers to the following works:

  • ① a work produced from identical image data,
  • ② a work produced by cropping or retouching identical image data to alter it,

    or
  • ③ a work produced from similar, though not identical, image data as described in ① or ② above (e.g. a frame from the same series of shots, photography conducted at a different date or time yet producing the same result, or a work otherwise deemed to be similar).

    Video Entries

  • Entry is limited to original works for which the entrant holds all applicable rights as a result of personally filming the video.
  • Only one video may be submitted.
  • Works that are identical or similar to another submitted work ("identical or similar works"*1) as well as works including identical or similar works submitted as separate works are ineligible for submission.

Note:
*1 "Identical or similar works" refers to the following works:

  • ① a work produced from identical video data,
  • ② a work produced by cropping or retouching identical video data to alter it,

    or
  • ③ a work produced from similar, though not identical, video data as described in ① or ② above (e.g. part of the same video, filming conducted at a different date or time yet producing the same result, or a work otherwise deemed to be similar).

Submission Guidelines

Photo Entries

  • Image data files created with any device capable of taking still images, including smartphones and digital still cameras (including medium and large-format digital cameras).
  • Images that have been retouched by using camera apps, photo editing apps, other software, etc. will be accepted.
  • Both color and monochrome images will be accepted.
  • File size: up to 20 MB of image data per work
  • Image-data file format: JPEG/150 dpi recommended
  • The standard color space for the judging process is sRGB.

Note:
Winners might be asked to provide higher resolution images for publication or display purposes related to the contest.

Video Entries

  • A video work consisting of video footage and/or still images with a length of 6 to 180 seconds.
  • Any video-recording device may be used.
  • 360° videos are restricted to edited works that do not rely on a 360° video playback device or application for viewing.
  • File size: up to 400 MB of video data at the time of submission per work. File format: MOV or MP4.
  • Any music used for the submitted work must not violate the copyrights or other rights of any third party.

Judging

  • After the first round of judging, all entries will be posted on this website (scheduled for May 2019). Winners of each award will be decided after the final round of judging (June). Contest results are scheduled to be announced on this website by September 2019.
  • In addition, everyone who has entered the contest has a right to vote for the Participants’ Choice Prize. All works that have passed the first round of judging will be subject to voting. Voting is scheduled for May 2019 or later. Details will be announced on this website.

Notification to Winners

After the judging concludes, the winners will be notified via email sent to their registered email addresses by mid-July 2019.

Note:
Winners are requested to access the URL in the award notification email sent by the Nikon Photo Contest Office, and they must accept the terms and conditions and register by the specified date. Failure to do so might result in disqualification. Winners might also be contacted by telephone or other means if the Nikon Photo Contest Office deems it necessary to confirm any of the information provided, etc.

Please note that failure to respond within 21 days of the date on which the Nikon Photo Contest Office sends the award notification email will result in disqualification, regardless of whether this is due to a server malfunction or any other cause. Entrants should therefore notify the organizer of any changes to their email addresses through My Page on this website. Neither the organizer nor the Nikon Photo Contest Office will accept liability for any disadvantages that arise as a result of inability to receive email.

Disclaimers

  • Entries and the persons depicted therein are restricted to works for which the entrant holds the copyright or for which the entrant has received the prior usage permission of the right holder.
  • Before submitting a work, the entrant is responsible for taking all steps necessary to protect the right of publicity and other rights of persons depicted in the work, including but not limited to obtaining their permission, to avoid any problems related to the infringement of these rights.
  • Entrants are responsible for the resolution of any legal issues arising from their submitted works and agree to pay any costs thereby incurred.
  • The organizer reserves the right to disallow entries that depict brand logos or other intellectual property, whether on neon signs, posters, or in other forms, or that in its judgment are harmful to public order, violate standards of decency, or are contrary to the goals of the contest.
  • Entrants must hold all applicable rights to the final image, including any retouching or other image processing.
  • Entrants will not be notified of the receipt of their entries. Please note that the organizer will not respond to inquiries concerning their receipt.
  • Entries are only accepted through the Internet.
  • Entrants must bear all costs incurred by entering the contest.
  • Entering the contest constitutes agreement to the terms and conditions stated in these Entry Guidelines.
  • The organizer reserves the right of final judgment concerning items not expressly stated in these Entry Guidelines. Entrants who do not consent to the organizer's decisions may withdraw from the contest. All costs associated with withdrawal from the contest are to be borne by the entrant.
  • Once submitted, entries will not be returned to entrants under any circumstances, even if they are later withdrawn.
  • Please note that the organizer may elect to suspend or postpone receipt of any or all entries if in its judgment the contest cannot be run smoothly, securely, or without affecting the fairness of the judging due to circumstances beyond its control, including but not limited to network failure, computer viruses, or unauthorized access to its servers.
  • Please note that when a winning work is used for exhibitions and the like stated below, due to circumstances concerning printing or otherwise, the tone or expressed meaning may not be strictly reproduced according to the winner's intent
  • Please note that no response will be given to any inquiries, complaints, or objections regarding the judges' decisions.

Responsibility

  • Although entries are handled with the greatest possible care, the organizer will not bear responsibility for accidents, damage, loss, or other problems that occur during data transfer.
  • The organizer will not bear responsibility for entrant damages, etc. arising from or related to circumstances beyond its control, including but not limited to network failure, computer viruses, or unauthorized access to its servers.
  • The organizer will not bear responsibility for damages or other harm suffered by entrants as a result of their participation in the contest.
  • Entrants are required to obtain the prior permission and consent of the persons who are portrayed in their works or who hold the copyright or other intellectual property rights to the works or the items portrayed therein.
  • Entrants agree to fully indemnify the organizer and bear all responsibility for any third-party complaints or objections concerning copyright or other intellectual-property-right infringement or damages arising from submitted works.
  • The above limitations also apply to the responsibilities borne by the organizer as well as the judges and third parties participating in the contest in cooperation with the organizer.

Entrants’ Rights

  • Although entrants retain the copyright and other equivalent rights to their entries, the organizer retains the entry rights listed below under "Organizer's Rights".

Organizer’s Rights

  • The organizer reserves the right to publish entries to its public social networking service accounts throughout the submission period to publicize the contest. Such publication does not guarantee an award of any kind.
  • The organizer reserves the right to publish all entries onto websites and social networking service accounts related to the contest after the first round of judging. Some entries might be cropped for publication.
  • With the objective of publicizing the contest and enriching the general image-making culture, the organizer reserves in perpetuity the non-exclusive right to publish, reproduce, make public, publicly transmit, display, print, distribute, and screen winning entries with the credit titles on websites and public social networking service accounts as well as in photo exhibitions, camera-related events, exhibitions, and the corresponding facilities managed or organized by the subsidiaries or affiliates of Nikon Group and local agents authorized by the organizer (collectively called the "organizer, etc.", a term that includes the organizer) without further compensation to or the additional prior consent of the winners.
  • The organizer, etc. will display the names of the winners and the titles of the winning entries on contest-related websites and public social networking service accounts, at exhibitions, and in other locations where the works are shown. Entrants are requested to familiarize themselves with the "Privacy Notice".
  • With the objective of accomplishing the goals outlined in the above clause, the organizer, etc. may:
    (a) display the winning entries in whole or in part on websites or public social networking service accounts under its administration, with the addition of graphical effects, sound effects, or music, and
    (b) employ the winning entries in whole or in part in the creation of posters, tickets, and pamphlets promoting photo exhibitions and other events. The winners agree not to exercise moral rights to works so used.
  • For objectives other than those stated above, upon agreement with the entrant or winner, the organizer reserves in perpetuity the non-exclusive right to publish, reproduce, make public, publicly transmit, display, print, distribute, and screen entries or winning entries with labels indicating them as entries or winning entries of the contest and the credit titles, without further compensation.
  • Entries that in the judgment of the organizer do not conform to these Entry Guidelines will be disqualified. Entrants will not be notified in this event.
  • If a winner is found to be disqualified after a prize is awarded, the award might be revoked and the entrant requested to return the prize.
  • These Entry Guidelines will be interpreted in accordance with the laws of Japan.
  • Any disputes between entrants and the organizer will be referred to the Tokyo District Court as the court of first instance having exclusive jurisdiction.

Handling of personal information

The Privacy Notice (A) is based on the Nikon Group Privacy Protection Statement <url: https://www.nikon.com/privacy/privacy_policy.htm >and applies to all personal data that Nikon Corporation (referred to below as “Nikon”) processes concerning Nikon Photo Contest under Act on the Protection of Personal Information and related laws and regulations of Japan. When submitting a work to the Contest, the entrant must fill out the entry form with accurate personal information and then submit it to the organizer. The provision of personal information is left to the sole discretion of the entrant. Note that the organizer will not accept entries in cases where the necessary personal information is not provided.

Purposes of use

We use personal information provided to us to the extent necessary for the purposes below.
The purposes of use in relation to entrants are as follows:

  • Notification concerning matters related to the Contest
  • Inquiries to entrants related to submitted works
  • Creating statistical data
  • Sending questionnaires related to the Contest


Personal information is also used in relation to winners for the following purposes:

  • Notifying winners that they have won or telling them about the award ceremony
  • Announcing winning works
  • Sending prizes
  • Communication with winners regarding requests to create contents


In addition, we sometimes refer to voluntarily provided questionnaire responses when developing products.

Data storage

Please note that, regardless of the entrant’s country of residence, the organizer reserves the right to store data provided upon entry (the image data of works and personal information) in Japan or another country.

The names of winners might be used for websites, printed materials, or other materials related to the Contest when introducing winning works. In addition, names might be used for identity verification when someone of the entrants wishes to change their address or otherwise update their personal data.
The Nikon Photo Contest Office will handle the above notifications and inquiries.

Disclosure to third parties

The organizer will provide personal data to judges and third parties involved in running the Contest to the extent necessary to run the Contest.
When providing personal data in accordance with the preceding paragraph, the organizer will execute contracts with the judges and third parties that contain provisions of confidentiality, or otherwise ensure that they manage personal data appropriately.

Security of personal data

We strive to ensure the security of personal data provided on the internet by using the Secure Sockets Layer (SSL) or an equivalent protocol to prevent unauthorized access.

Disposal and deletion of personal data

The organizer will take procedures to dispose of or delete provided personal data (entry forms, the data of submitted works, and other digitized personal data related to the Contest) on December 31, 2019 (the "disposal date") except for the personal data related to winners of the Contest or entrants whose submitted works will be used for purposes other than Contest promotion ("winners, etc.") and the personal information of entrants who wish to be notified by email the next Contest. Due to the above, please note that, except for winners, etc., it will no longer be possible to update or refer for the personal data of entrants as of the disposal date.

PRIVACY NOTICE (B) FOR THE NIKON PHOTO CONTEST

In this privacy notice we explain how we collect and use your personal data for the Nikon Photo Contest.

Nikon respects privacy and acknowledges that processing personal data in a lawful and proper manner is an important social responsibility and declares that it will strive to protect personal data. This privacy notice is part of Nikon’s Group Privacy Protection Statement<url: www.nikon.co.jp/main/eng/privacy_policy.htm >and applies to personal data that we process of participants in the context of the Nikon Photo Contest (hereafter “you”). In this privacy notice, we explain which personal data we collect and how we use these data. Therefore, we encourage you to read this notice carefully.

1. Who we are

We are Nikon Corporation, Shinagawa Intercity Tower C, 2-15-3, Konan, Minato-ku, Tokyo, 108-6290, Japan. We are responsible for the collection and use of your personal data described in this privacy notice.

We have determined our respective responsibilities for compliance with the obligations under applicable privacy legislation for processing your personal data in relation to our global processing activities by means of an arrangement between us. In summary, we have arranged that if you want to exercise your rights, such as your right to access, correct, erase, restrict, object or port personal data or to withdraw your consent, or if you have any questions about the processing of your personal data, you can contact us through the contact details in ‘Paragraph 9 Contact details for your privacy inquiries’ below. Nikon Group companies and Nikon Corporation will assist each other where necessary to ensure that you can exercise your rights and your questions will be handled.

2. What personal data we collect and what we do with your data

The Photo Contest is open to all persons eligible to participate and can be accessed in the manners described in the Nikon Contest Official Rules<url: http://www.nikon-photocontest.com/en/entry/ >. The types of personal data we collect include: your name, email address, country, nationality, date of birth, gender (optional), occupation (optional), and your uploaded photo and its title, including an identifier to ensure that the file name of your photo is unique. We later request only to the winners to register mailing address, postal code, phone number and FAX number as additional personal data.

You are solely responsible for the content you share with us and we ask you to inform a person whose picture you use in the context of the Nikon Photo Contest, as described in this Privacy Notice.

Sensitive data

When uploading photos for the Nikon Photo Contest we may receive sensitive data from you in the form of a person’s picture. You are solely responsible for the content you share with us and you will provide notice about and obtain a person’s prior consent for the use of the person’s picture in the context of the Nikon Photo Contest as described in this Privacy Notice. In certain cases, a person’s picture could be considered “special categories of personal data” under applicable data protection laws. For example, pictures revealing racial or ethnic origin, political opinions, religious or philosophical beliefs or concerning health or concerning someone’s sex life or sexual orientation may qualify as special personal data. In such cases, you will have to formally obtain the person’s consent in writing, if the special data is not manifestly made public by the persons themselves. At the time of your application, Nikon deems the person’s consent in writing was formally obtained by the applicant and Nikon shall not be responsible in case of failure of the consent.

Purposes

Nikon uses your personal information for the execution of the Photo Contest as further described in the Nikon Photo Contest Entry Guidelines<url: http://www.nikon-photocontest.com/en/entry/ >, for example to notify winners of the results, curry out promotion campaign during the Photo Contest, provide entrants with information about the contest, correspond with entrants about their submissions, announce the winning entries, generate general contest statistics, send out questionnaires about the contest and deliver prizes, and also for sending newsletters to announce next year’s contest.

In addition, Nikon uses your personal information in your submitted photos, their titles and your name for advertisement purpose and social action program for enriching the general image-making culture on the occasions as stated in “Organizer's Rights” of Nikon Photo Contest Entry Guidelines.

Furthermore, we may use your submitted photos, their titles and name in any media for Nikon’s business purposes, including for example in sales presentations, intranet websites, training materials, calendars, newsletters, posters, onsite photo galleries, recruitment materials, company brochures or other company publications, screensavers, mouse pads and/or other similar materials.

Please note that the personal data of the Contest award winners will be also used for arranging a trip to the award ceremony, for shipping a prize, for making media contents such as articles and interviews and for consideration for those contents.

Legal basis

Nikon processes your personal data and the person(s) in the picture to have you participate in the Nikon Photo Contest as necessary for our legitimate interests or the interests of a third party or on the basis of consent.

When we process your personal data for our legitimate interests or the interests of a third party, we will take reasonable measures to prevent unwarranted harm to you. Our legitimate interests are, for example, to communicate photos taking part in the Nikon Photo Contest and promote the competition. More information on the balancing tests we perform is available upon request. Where we process your personal data for our legitimate interests or the interests of a third party, you have the right to object at any time on grounds relating to your particular situation (please see ‘Paragraph 7. Your rights’ below).

You can withdraw your consent at any time by following the specific instructions in relation to the processing for which you provided your consent, by adjusting your setting (if available) or by reaching us through the contact details in ‘Paragraph 9 Contact details for your privacy inquiries’ below.

Where we process your personal data for a purpose other than that for which we collected it initially (and we rely on a legal basis other than consent or complying with legal obligations for this new purpose), we will ascertain whether processing for this new purpose is compatible with the purpose for which the personal data were initially collected. More information on this assessment is available upon request (please see ‘Paragraph 7. Your rights below).

3. How we collect your data

The personal data we process is information that you knowingly provide to us directly. If you refuse to provide personal data that we require for the Nikon Photo Contest, we may not be able to have you participate in the competition.

4. Information sharing

We will process some of your personal data locally. However, as a global organization and competition, the Nikon Photo Contest can also be carried out (and business efficiencies achieved) by processing or consolidating information about you in specific or centralized databases and systems located at specific secured facilities worldwide. As a result, your information may be shared with other entities within the Nikon Group. However, each Nikon Group company and those other systems and databases will only collect, receive, use, share or otherwise process such personal data in accordance with applicable laws, this privacy notice and our Nikon Group Privacy Protection Statement <url: httpwww.nikon.co.jp/main/eng/privacy_policy.htm >. Moreover, internally we maintain a strict access policy with regard to the processing of personal data. Only a limited group of authorized Nikon staff on a need to know basis will have access to your personal data.

As a rule, we do not share your personal data with anyone outside the Nikon Group, to judges and to third parties overseeing the contest, besides your competing photo, the title and its maker. The photo may be used in any media for Nikon’s internal use and business purposes and may be accessed on a global level. As well as your photo, we may share your personal data with trusted third parties that perform business functions or provide services to us. All such third parties will be required to adequately safeguard your personal data, subject to agreements that correspond to the requirements of applicable laws. Your personal data may also be shared for investigations (e.g. disclosure to prevent crime or fraud, or to comply with a court order or legislation).

5. Security measures and data retention

Nikon will secure your personal data in accordance with our IT and security policies so that personal data are protected against unauthorized use, unauthorized access and wrongful modifications, loss or destruction. Your personal data will be stored no longer than is necessary for the purpose of your participation in the Nikon Photo Contest, compliance with legal and fiscal obligations and for solving any disputes. The specific data retention periods for the processing activities are in principle kept until the end of the year of the Nikon Photo Contest, except for the case that we keep your email address until the end of the next year of the Nikon Photo Contest upon your request to subscribe the notification email for the next Nikon Photo Contest, the case that your personal data and photo are stored for 5 years as a result of winning an award of the Contest, the case that some entrants personal data are stored for 3 years to be used for Nikon’s business purposes, for example calendars, or the case that it is necessary to perform agreements with you or necessary for legal obligations.

Also please note that when we delete your personal data which we initially obtained at the time of your application upon your request to erase the data, we retain such information of the request email, and your personal data of your name and your email address, as a proof of the erasure after the deletion until we delete it together with other applicants’ personal data at the end of the year of the Nikon Photo Contest

6. International transfers of personal data

Given the global nature of our company, your personal data may be transferred to Nikon entities and trusted third parties in countries outside the European Economic Area whose laws may not afford the same level of protection of your personal data. Where necessary, Nikon will ensure that adequate safeguards are in place to comply with the requirements for the international transfer of personal data under applicable privacy laws. For transfers of personal data outside the European Economic Area, Nikon will use Commission approved mechanisms, such as the Privacy Shield certification, and Standard Contractual Clauses as safeguards, such as the “(EU-)controller to (Non-EU/EEA-)controller” Decision 2004/915//EC (see Article 46 GDPR). If you wish to receive a copy of these safeguards, please contact us through the contact details in Paragraph 9. ‘Contact details for you privacy inquiries’ below.

7. Your rights

You can contact us (please Paragraph 9. ‘Contact details for your privacy inquiries’ below) to exercise any of the rights you are granted under applicable data protection laws, which includes (1) the right to access your data, (2) to rectify them, (3) to erase them, (4) to restrict the processing of your data, (5) the right to receiving a file of your personal data and (6) the right to object to the processing, and where we have asked for your consent, to withdraw this consent. These rights will be limited in some situations. We will, for example, deny your request for access when necessary to protect the rights and freedoms of other individuals or refuse to delete your personal data in case the processing of such data is necessary for compliance with legal obligations. The right to data portability, for example, does not apply in case the personal data was not provided by you or if we process the data not on the basis of your consent or for the performance of a contract.

7.1. Right to access

You may ask us whether or not we process any of your personal data and, if so, receive access to that data in the form of a copy. When complying with an access request, we will also provide you with additional information, such as the purposes of the processing, the categories of personal data concerned as well as any other information necessary for you to exercise the essence of this right.

7.2. Right to rectification

You have the right to have your data rectified in case of inaccuracy or incompleteness. Upon request, we will correct inaccurate personal data about you and, taking into account the purposes of the processing, complete incomplete personal data, which may include the provision of a supplementary statement.

7.3. Right to erasure

You also have the right to have your personal data erased, which means the deletion of your data by us and, where possible, any other controller to whom your data has previously been made public by us. Erasure of your personal data only finds place in certain cases, prescribed by law and listed under article 17 of the General Data Protection Regulation (GDPR). This includes situations where your personal data are no longer necessary in relation to the initial purposes for which they were processed as well as situations where they were processed unlawfully. Due to the way we maintain certain services, it may take some time before backup copies are erased.

7.4. Right to restriction of processing

You have the right to obtain the restriction of the processing of your personal data, which means that we suspend the processing of your data for a certain period of time. Circumstances which may give rise to this right include situations where the accuracy of your personal data was contested but some time is needed for us to verify their (in)accuracy. This right does not prevent us from continue storing your personal data. We will inform you before the restriction is lifted.

7.5. Right to receive your file (data portability)

Your right to data portability entails that you may request us to provide you with your personal data in a structured, commonly used and machine-readable format and to have such data transmitted directly to another controller, where technically feasible. Upon request and where this is technically feasible we will transmit your personal data directly to the other controller.

7.6. Right to object

You also have the right to object to the processing of your personal data, which means you may request us to no longer process your personal data. This only applies in case the ‘legitimate interests’ ground (including profiling) constitutes the legal basis for processing (see par. ‘Legal basis’ above).

At any time and free of charge you can object to direct marketing purposes in case your personal data are processed for such purposes, which includes profiling purposes to the extent that it is related to such direct marketing. In case you exercise this right, we will no longer process your personal data for such purposes.
